Full Description

Rafattullah Rustayee, a 25-year-old man from Dudley, was sentenced at Wolverhampton Crown Court for possessing and distributing indecent images of children. The court heard that police received intelligence about indecent images being uploaded to the internet, leading to a warrant being executed at his home in October 2024. Officers seized an iPhone, iPad, and iMac from his address at Claverley Court, Vicarage Prospect.

Upon examination, 885 indecent images of children aged between three and 15 were discovered on the iPhone and iPad, including nearly three hours of moving sex abuse content. Nothing incriminating was found on the iMac. Prosecutor Thomas Duggan informed the court that Rustayee had been distributing images online from 20 November 2023 to 2 October 2024, using a Telegram account to share 59 indecent images in a forum with other paedophiles. He actively searched for illegal content, including requests for BDSM, bondage, and sadomasochism material, and engaged in conversations about sexual interest in children.

Defending barrister Ammo Khanna described Rustayee as a man of few words who expressed remorse and recognised his problem, though he came from a culture of stoicism that discouraged seeking help. Khanna noted his difficult life as a refugee who arrived in the UK about seven years ago, having witnessed violence including killings in his home country. Rustayee had no previous convictions and was struggling with mental health issues since his arrest, expressing a desire to seek therapy.

Sentencing on 11 December 2024, Recorder Michael Duck KC stated: 'Without people like you who possess, and more seriously, distribute these images, there would not be a market of images of children being subjected to the appalling abuse which features in this case. You perpetuate that market.' Rustayee admitted three counts of making indecent images of children and three counts of distributing them. He was jailed for 28 months, made subject to a 10-year sexual harm prevention order, and required to remain on the sex offenders register for a decade. Concerns were raised about potential deportation despite his leave to remain in Britain.
