Offence Summary

A registered sex offender from Gillingham was jailed for breaching his sexual harm prevention order by using private browsing mode on his mobile phone.

Full Description

Registered sex offender Malcom Nix, 66, from Gillingham, was jailed after being found to have breached the conditions of an indefinite sexual harm prevention order (SHPO) imposed following his 2015 conviction for sexual offences involving children.

Kent Police officers visited Nix’s home on Trafalgar Street on 9 September 2025 to conduct a routine check. Nix initially refused to allow officers entry and was asked to hand over all internet-enabled devices. He provided his mobile phone, which investigators found had been used in private browsing mode, in direct breach of the SHPO requirement that any device used to access the internet must retain and display browsing history.

Nix, of Trafalgar Street, Gillingham, was charged the following day and remanded in custody. He pleaded guilty at Maidstone Crown Court and, on 18 February 2026, was sentenced to 13 months’ imprisonment. He remains subject to the indefinite SHPO.

Investigating officer PC Areolito Gashi stated: "We regularly visit registered sex offenders living in our communities to monitor their conduct and ensure they are complying with any conditions in place to prevent further crimes. In this way, we endeavour to protect the most vulnerable in our community. Nix has shown that he remains a danger to children and, once his crimes were discovered, he was swiftly arrested and brought back before the court to answer for his actions."

The case was prosecuted by Kent Police and heard at Maidstone Crown Court.
