Rhian Eleri Desouza, a 43-year-old headteacher at Ysgol Gynradd Gymraeg Gellionnen in Clydach, Swansea, was sentenced at Swansea Crown Court for making indecent images of a child. The case came to light after police recovered two images from her Samsung telephone using specialist software: one classified as category A, the most serious, and one as category C. These images had been sent to Desouza by a 16-year-old girl via Snapchat in May and June 2018.

Desouza was arrested on 14 August 2018 and initially provided no comment during her police interview. She appeared before Llanelli Magistrates’ Court on 15 August 2018, where she indicated guilty pleas to two counts of making an indecent photograph of a child. A pre-sentence report presented in court detailed her remorse, noting she was “mortified” to learn that receiving the images was illegal and had pleaded guilty at the first opportunity. Her solicitor, Carina Hughes, emphasised Desouza’s dedication as a teacher and the severe personal consequences, stating: “She has always been a dedicated teacher and is held in high regard by other members of her profession as well as the community. She has lost her profession and her financial independence and the stress and anxiety has been a punishment whilst awaiting punishment for this case.”

Sentencing on 14 September 2018, Judge Paul Thomas QC described the circumstances as “very unusual” and “unique” in his extensive experience with such cases. He acknowledged significant local outrage, saying: “When I read the substantial media coverage my initial reaction was a prison sentence had to be inevitable. There was a great deal of local outrage expressed and I can fully understand why this would be. This would send a shiver down the spine of any parent.” However, he noted key differences from typical cases: the girl was 16, above the age of consent, the images were sent consensually, and there was no distribution. The judge clarified: “That, however, is not to trivialise what you did. As a result of having two photos you will no doubt lose your job and lose your career. I see no way you can teach again. This is not a court of morals - it is a court of law.” Desouza received a two-year community order, including 25 days of rehabilitation activity and 200 hours of unpaid work, and was required to sign the sex offenders’ register for five years.

The case had no connection to pupils at Desouza’s school. A joint statement from Swansea Council and the school reassured parents: “We would like to reassure parents that the court proceedings do not relate to any pupil, past or present, at any school the individual has taught at. As soon as we were made aware of the investigation by police she was suspended and remains so.” Desouza, from Five Roads in Llanelli, was suspended immediately upon police involvement, with an acting headteacher appointed to maintain school operations.

A statement from the teenage victim’s mother highlighted the family’s distress: “These last few months have been the darkest and most horrendous anyone can imagine. Our world has fallen apart and at times it’s been difficult to look beyond tomorrow. As a family we have been left to question why she has been taken advantage of emotionally. We have been caught up in a storm. She has lost an incredible amount of weight and her self-esteem is very low.” Following the hearing, Swansea Council reiterated that the proceedings were unrelated to any school pupils and thanked the community for their support.
