Full Description

Kenneth Arthur Jenkins, a 63-year-old man from Cwmfelinfach, was sentenced to six months in prison after police discovered a collection of indecent images of children on his computer during a raid on his home. The case, which came before Cardiff Crown Court, highlighted the severity of possessing such material, with Jenkins admitting to the offence of possession of indecent photographs of children.

On 29 July 2015, officers from Gwent Police executed a search warrant at Jenkins' residence on King Street, Cwmfelinfach, near Crosskeys. During the search, they uncovered 57 indecent images stored on his computer, including 10 classified in the most obscene category A. These images depicted children as young as three years old engaged in sexual activity with adult males, underscoring the disturbing nature of the content. Judge Julian Goose QC, presiding over the subsequent appeal hearing, described the photographs as 'sickening' in his ruling.

Jenkins was arrested and charged following the discovery. On 4 December 2015, at Cardiff Crown Court, he pleaded guilty at the earliest opportunity and was sentenced to a six-month custodial term by the trial judge. Despite his previous good character, the court deemed the possession of such material warranted imprisonment rather than a community order.

Unsatisfied with the sentence, Jenkins appealed to the Court of Appeal in London, arguing that the term was manifestly excessive. His legal team contended that he should have received a community order and been enrolled in a treatment programme for internet sex offenders, emphasising a 'real prospect of rehabilitation' and noting that the prison sentence would release him without any support. They highlighted his early guilty plea and lack of prior convictions as mitigating factors.

However, on 14 January 2016, the appeal was heard before a panel comprising Judge Julian Goose QC, Lady Justice Sharp, and Mr Justice Dingemans. The judges rejected the appeal, with Judge Goose stating: 'We don’t agree that this sentence was manifestly excessive.' The court upheld the original six-month prison sentence, affirming that it was appropriate given the quantity and severity of the images. This ruling serves as a reminder of the judiciary's stance on child sexual exploitation material, as reported by Wales Online and Strand News Agency.
