Offence Summary

A former transport driver breached his sexual harm prevention order by failing to disclose a new iPhone after prior convictions for possessing indecent images and inciting children.

Full Description

Vasiq Moughal, 61, of Riverside Park in Weybridge, was sentenced to a 12-month community order in August 2019 at Guildford Crown Court for breaching his sexual harm prevention order (SHPO). In July 2018, he had received a nine-month suspended sentence for possession of an indecent image of a child and two counts of inciting a child to engage in sexual activity, committed while driving a school bus and engaging two children in sexual chat. Less than two months later, Moughal purchased a new iPhone but failed to inform police, violating SHPO terms requiring disclosure of internet-accessible devices.

Judge Robert Fraser noted the breach was minor and considered Moughal's new job as a courier and his seriously ill wife, deeming activation of the suspended sentence unjust. He imposed the community order, warning Moughal of the importance of compliance. The case was investigated by Surrey Police.
