On the evening of 7 May 2024, a horrific stranger rape occurred in a town centre pub in Scarborough, North Yorkshire. Szczepan Zenon Malczewski, a 38-year-old man from Eastfield, followed a young woman in her early 20s into the pub's toilets around 10.40pm. The victim had been drinking with friends earlier in the evening before they left for home, leaving her vulnerable as Malczewski trailed her.
Once inside the toilets, Malczewski refused to allow the victim to leave, trapping her in a confined space. He then subjected her to a brutal sexual assault, raping her and committing sexual assault by penetration for approximately 10 minutes. Despite the victim's repeated cries for him to stop and clear lack of consent, Malczewski persisted in his attack, leaving her terrified and traumatised. Concerned pub staff eventually intervened, helping the victim out of the toilets after hearing her distress.
Uniformed officers from North Yorkshire Police were called to the scene immediately after the incident. They arrested Malczewski nearby, where he was taken into custody. The victim was promptly provided with specialist care and support from police and partner agencies, including the Sexual Assault Referral Centre, to address the immediate aftermath of the ordeal.
The investigation was led by Detective Constable Nick Burton from Scarborough and Ryedale CID. Key evidence included forensic materials from the scene and crucial CCTV footage from the communal area of the toilets. As DC Burton noted, 'This particular CCTV footage clearly showed Malczewski’s movements and behaviour in the build-up to the incident, along with his aggressive demeanour towards the victim when she was helped out of the toilets by concerned staff members.' The footage captured Malczewski's predatory actions leading up to the assault and his continued aggression afterwards, during which the victim was in a state of collapse.
During police interviews, the evidence against Malczewski proved overwhelming. He admitted that the victim had not consented at any stage and expressed shame upon viewing the CCTV footage of his own behaviour. This confession, combined with the forensic and visual evidence, formed the basis of the case presented at York Crown Court.
On 2 August 2024, Malczewski appeared at York Crown Court, where he had previously pleaded guilty to the charges of rape and sexual assault by penetration. He was sentenced to two years and nine months' imprisonment for the horrendous attack. Additionally, he was placed on the Register of Sex Offenders indefinitely to ensure ongoing monitoring. DC Burton commended the victim's courage, stating, 'The victim has been courageous throughout and I truly hope she can take strength from the sentencing knowing her attacker has rightly been imprisoned and will be closely monitored by law enforcement authorities for the rest of his life.' The case underscores North Yorkshire Police's commitment to pursuing justice in stranger rape investigations, as highlighted by the thorough evidence gathering and rapid response.
