The court heard that Ncube, who was part of the care team responsible for the victim's wellbeing, admitted to two counts of engaging in sexual activity with a person with a mental disorder while acting in his capacity as a care worker. The victim, who was clearly suffering from intense mental health issues, was often restrained by the team, including Ncube, making his awareness of her vulnerability indisputable.

During the trial, the victim provided a powerful testimony from the witness box, confronting Ncube directly with the words: 'How dare you. Very often you were part of the team restraining me. It must have been very clear to you I was intensely unwell.' This statement underscored the profound breach of trust involved in the offences, as Ncube exploited his position of authority and the victim's impaired state.
