Full Description

Gareth Mitchell, a 41-year-old man from Cwmbran, Torfaen, committed a sexual assault by penetration against a girl over the age of 16. The incident came to light when the victim confided in a counsellor about the attack, prompting police involvement. Upon being confronted with the allegations, Mitchell immediately admitted, stating, 'I did it,' and expressed despair by saying, 'I'll be dead within the hour.'

Following his admission, Gwent Police located Mitchell in a car where he was attempting to take his own life. He was taken into custody but made another suicide attempt there, leading to hospitalisation. Released the next day, Mitchell was interviewed and provided a prepared statement in which he fully admitted the offences, apologised, and vowed, 'It will never happen again.' He later pleaded guilty to the sexual offences at Cardiff Crown Court.

The court heard that Mitchell was of previous good character. In a victim personal statement, the victim described the profound impact of the assault, noting a severe deterioration in her mental health. She stated, 'I have been suffering as a result of what he did to me... As a result of his actions against me my mental health has got a lot worse. I have been self-harming every week at least once a week.' She explained that prior to the incident, she had achieved stability after earlier struggles with bullying and self-harm, but the assault reignited these issues, leaving her anxious, fearful of leaving the house alone, and constantly vigilant for potential threats.

In mitigation, defence barrister Jeffrey Jones highlighted Mitchell's immediate admissions and suicide attempts as evidence of deep remorse, describing his life as 'likely to be altered forever with natural hostility and isolation.' Sentencing judge Recorder Greg Bull KC acknowledged the incident was not prolonged but had a 'profound effect' on the victim. He imposed a three-year custodial sentence on Mitchell, along with a sexual harm prevention order and indefinite sex offender notification requirements.
