A man from Swindon has been imprisoned for raping a woman after a night out, in a case that highlights the dangers of blurred boundaries in social interactions.

Nicolae Byfield, aged 34, was sentenced at Swindon Crown Court on Thursday, December 12, following his conviction on two counts of rape on Tuesday, November 19. The court heard that Byfield had met the victim during a night out. When she declined his offer to drive her home, she ended up staying at his address instead. Under the influence of alcohol but not incapacitated, the victim was subjected to non-consensual sex by Byfield, who exploited the situation despite her clear refusals.

Judge Jason Taylor KC remarked during sentencing that while there may have been legitimate grounds for Byfield to believe the victim was attracted to him, he nevertheless took advantage of her vulnerability. Recordings from the incident captured the victim explicitly saying 'no' to Byfield's advances, providing crucial evidence of the lack of consent. The judge emphasised the gravity of the offence, noting Byfield's actions in proceeding despite these protests.

Prosecutor Alexandra Bull detailed the profound impact on the victim, stating that her health had been severely affected and that 'she wouldn't go back to who she was before'. The assault strained her relationships with family and friends, leading to sleep difficulties and the need for antidepressants. In mitigation, defence barrister Harbinder Singh Lally submitted letters from female family members and friends portraying a 'different side' to Byfield, describing him as respectful until the moment of offending. Byfield appeared via video link from HMP Bullingdon in Oxfordshire and has 10 previous convictions since 2006, none relevant to this case.

Byfield received four years' imprisonment on each count, to be served concurrently, marking a custodial sentence for these serious sexual offences. The case was heard at Swindon Crown Court, with reporting by Joe Green for the Swindon Advertiser.
