Daniel Smith was found guilty of raping a sleeping woman, sexually assaulting her on another occasion, and breaching a Sexual Harm Prevention Order. He has been remanded in custody awaiting sentencing in January.

Full Description

Daniel Smith, a 45-year-old man from Ladywell Close in North Leigh, Oxfordshire, was convicted at Swindon Crown Court of multiple sexual offences against a woman he knew. The jury found him guilty of rape, sexual assault, and breaching a Sexual Harm Prevention Order following a trial that highlighted the severity of his actions.

The first incident occurred on 4 November 2023, inside a property in Highworth, Wiltshire. Smith entered the property and raped the woman while she was asleep, exploiting her vulnerability in that moment. Less than a month later, on 9 December 2023, he repeated his assault by climbing into the same bed without her consent and sexually assaulting her again. These acts formed the basis of the charges against him.

The victim, a woman in her 30s, bravely reported the offences to Wiltshire Police on 18 December 2023. Officers arrested Smith later that day. Despite his plea of not guilty, the evidence presented during the trial at Swindon Crown Court led to convictions on all counts. The court heard detailed accounts of the incidents, underscoring the breach of trust and the non-consensual nature of the assaults.

Detective Constable Hemns, who led the investigation for Wiltshire Police, commended the victim's resilience. In a statement, he said, 'The verdict offers hope that the woman could now begin to move forward after two difficult years.' Smith was remanded in custody following the guilty verdict and is scheduled to return to court for sentencing in January 2025.

This case, reported by The Swindonian, serves as a stark reminder of the importance of reporting sexual offences and the pursuit of justice through the legal system in the United Kingdom.
