Leslie Rutherford, a 70-year-old cancer patient from Kirkcaldy in Fife, has a long history of possessing child abuse material, with his most recent offence uncovered during a routine check by authorities. Previously convicted in 2021 for amassing 373,000 vile child abuse files over two decades, Rutherford was sentenced to a three-year community payback order. He reoffended, appearing in Edinburgh Sheriff Court in 2024 to admit stockpiling another million disgusting files, again receiving a community payback order.

On October 29, 2023, a detective and social worker conducted a cursory check of Rutherford's home in Kirkcaldy, where he had lived since August 2022, with his consent. During the visit, the detective spotted a tablet in a protective case on Rutherford's mattress and a handset on his bedside cabinet. Rutherford initially lied, claiming the tablet was merely a book, in an attempt to conceal it. Upon examination, the device revealed evidence of more than 500 illicit files, some depicting naked youngsters in the bath and others showing semi-naked children in swimwear. Investigations further showed that Rutherford had been actively searching online for children's swimwear and browsing various shopping websites.

Rutherford, who suffers from bowel and prostate cancer, appeared at Kirkcaldy Sheriff Court on an unspecified date in 2024, carrying a plastic carrier bag full of medical prescriptions. He pleaded guilty to taking or making illicit images between July 2023 and October 2024. His solicitor, Graham Inch, noted to the court: "Mr Rutherford is currently subject to supervision, he has been co-operating with his community payback order." Sheriff Robert More described Rutherford as a recidivist who had complicated the sentencing process with his two prior analogous convictions. The sheriff placed Rutherford on the sex offenders register again, continued his bail, and ordered pre-sentencing reports to be prepared. A motion was also made to forfeit the offending gadgets.

This case highlights Rutherford's persistent 'sick habit' spanning decades, which contributed to the breakdown of his marriage following the 2021 raid on his former Edinburgh home.
