Offence Summary

James Ballard, a convicted paedophile from Brighouse, breached his Sexual Offences Prevention Order by installing software on his phone to access the dark web and possessing borderline indecent images of children. He received an 18-month community order.

Full Description

James Ballard, a registered paedophile from Brighouse in West Yorkshire, appeared in court this week for breaching an indefinite Sexual Offences Prevention Order imposed in 2013 following his conviction for possessing indecent images of children. The order was designed to prevent further offending, but Ballard tampered with his device to access prohibited content.

  • In August 2023, public protection officers from West Yorkshire Police conducted a routine visit to Ballard's home.
  • He surrendered a Galaxy Flip mobile phone, on which investigators discovered that a web browser had been uninstalled, suggesting an attempt to conceal activity.
  • The device contained 'borderline' images of children and evidence of access to the dark web, a platform often used for illegal material.

Ballard had previously received a suspended sentence in 2024 for an earlier breach of the order. At the hearing in a Yorkshire court, the judge opted not to impose immediate custody, instead handing down an 18-month community order with requirements to address his behaviour. This decision balanced punishment with rehabilitation, though concerns were raised about the ongoing risk he posed. West Yorkshire Police emphasised their commitment to monitoring individuals under such orders, stating, 'We work tirelessly to protect children from predators like Ballard, and any breach is taken extremely seriously.' The case serves as a reminder of the challenges in supervising sex offenders post-conviction.
