A man from Darwen has been sentenced for voyeurism after secretly recording a private sexual act involving his partner and distributing the footage to a third party without consent. The case, heard at Blackburn Magistrates' Court, highlights the severe consequences of non-consensual sharing of intimate images.
Alistair Watson, 24, of Kelvin Street, Darwen, engaged in online communications with an individual he believed to be a woman named Amy on the Kik messaging app. According to court proceedings reported by the Lancashire Telegraph on 27th November 2021, Watson initially sent explicit images of himself masturbating in response to requests from this online contact. The conversation escalated when he shared nude photographs of his unsuspecting partner and, crucially, a secretly recorded video of them having sex on the couch.
Prosecutor Peter Kelly detailed that Watson's partner was completely unaware of the recording and had not given any permission for the images or video to be disclosed to anyone else. The betrayal came to light after the online contact, who turned out to be involved in what defence counsel described as possible entrapment, attempted to blackmail Watson by threatening to expose his actions to his partner. Watson confessed everything to his girlfriend, who promptly reported the matter to the police, leading to his arrest.
Watson pleaded guilty to voyeurism by recording another person doing a private act, with the intention that he and a third person would view the image for sexual gratification, knowing the other person did not consent. In mitigation, defending solicitor Peter King argued that Watson had been drawn into a situation beyond his control, believing the online contact could be traced but ultimately stopping the communications when he realised the risks. King emphasised Watson's remorse, stating, 'He is aware of the distress he has caused and is desperate to ensure he is taking full responsibility for what has happened.' He further noted that Watson 'never thought it would develop into a situation where he had no control and he was being exploited by this other person.'
The court imposed a 24-week prison sentence, suspended for 24 months, alongside a community order requiring 35 days of Rehabilitation Activity Requirement and 60 hours of unpaid work. Watson was also subjected to a 12-month restraining order prohibiting contact with the victim, ordered to pay £85 in costs and a £128 victim surcharge, and required to register as a sex offender for seven years. This case underscores the legal ramifications of voyeurism and the non-consensual distribution of intimate material under UK law.
