Full Description

David Clark, a 37-year-old resident of Harrogate, North Yorkshire, appeared before Harrogate Magistrates Court on 19 December 2025 for sentencing after admitting to possessing indecent images of children.

The offence occurred on 13 August 2023, when police arrested Clark at his home on Silverfields Road. Officers seized a Samsung Galaxy phone during the search, on which they discovered four category C indecent images depicting females aged between 14 and 16. Clark had previously pleaded guilty to the possession charge at a hearing on 23 August 2025.

During the sentencing hearing, Antony Farrell, the prosecutor, outlined the details of the case to the magistrates. He noted that the images were found on the device and requested the court consider a community order as an appropriate penalty, given the nature of the offence.

Andrew Tinning, representing Clark, argued in defence that a community order was entirely suitable. He emphasised that there were no aggravating features to the case and that Clark had no prior relevant convictions, supporting a non-custodial outcome.

The magistrates agreed with the submissions from both sides and imposed an 18-month community order on Clark. This included 25 days of rehabilitation activities and 140 hours of unpaid community service. Additionally, Clark was ordered to pay a victims' surcharge of £114 and court costs amounting to £85.

The case was reported by The Stray Ferret, a local news outlet covering Harrogate and surrounding areas, highlighting the importance of community-based sentencing in such matters.
