Offence Summary

Raped a woman while she slept after she had fallen asleep at his home following a night out.

Full Description

Kyle Plummer, 32, of Mountain Ash, was found guilty of rape after a trial at Merthyr Tydfil Crown Court. The court heard that in 2023, Plummer and the victim had attended the same venue and had been drinking alcohol. They agreed to walk back to the defendant's home to talk, but the victim felt dizzy and lay down for a nap.

After the victim had fallen asleep, Plummer took the opportunity to lie down next to her, remove her trousers and underwear, and rape her. She woke up during the incident and told him to get off her. The victim ran out of Plummer's home and did not wash for three days while undergoing forensic examination after reporting the matter to the police.

Plummer, of Rowan Close, denied a charge of rape but was found guilty by a jury. The court heard the defendant has no previous convictions but has two cautions for offences including battery. In a victim personal statement, the victim described the lasting impact of the attack, including trouble sleeping, flashbacks, and effects on her new relationship. She also stated she thought she could have been left pregnant by her attacker.

Sentencing Plummer on 29 May 2026, Judge Celia Hughes said: "It was clear to me and the jury that you raped her while she was asleep with your penis. You had no care about whether she consented or not." The judge noted Plummer was "disinhibited by alcohol and sexually frustrated as the relationship with your wife was not going well."

Plummer was sentenced to six years and six months imprisonment, made subject to a restraining order for 10 years, and made subject to sex offender notification requirements indefinitely. In mitigation, it was said Plummer had spent time living in care as a child and has been diagnosed with autism, and that his wife has severe mental health issues.
