Offence Summary

Delyth Davies sexually assaulted a boy and engaged in threatening behaviour, receiving a suspended sentence of 21 months imprisonment in April 2024. She later breached the terms by failing to attend a required appointment, but was ordered to complete six months of drug rehabilitation instead of jail.

Full Description

In April 2024, Delyth Davies, a 38-year-old woman from Anglesey, was sentenced at Caernarfon Crown Court for sexually assaulting a boy and committing threatening behaviour. The court imposed a 21-month prison sentence, suspended for two years, allowing her to avoid immediate custody provided she adhered to strict conditions.

Davies, residing in Maes Meurig, Gwalchmai, pleaded guilty to the charges. The original offences involved sexual assault on a young boy, highlighting a serious breach of trust. Despite the gravity of her actions, the suspended sentence reflected considerations of her circumstances at the time.

On August 19, 2024, Davies returned to Caernarfon Crown Court after admitting to breaching the terms of her suspended sentence. The breach occurred when she failed to attend a pre-planned appointment on June 30, 2024, which was not her first instance of non-compliance. Her defence representative, Joshua Gorst, explained that Davies accepted she had no reasonable excuse for missing the appointment. He noted that she had been suffering acutely from mental health difficulties, worsened by substance misuse, but had since made a dramatic improvement.

Presiding Judge Timothy Petts opted not to activate the suspended sentence, instead ordering Davies to complete six months of drug rehabilitation requirements. Addressing her directly, the judge stated: "Had this come before the court last month, the chances are you’d have been sent to prison." He added: "But in the last few weeks, I’m pleased to hear, you have got back onto the straight and narrow. But you are on thin ice, because you can’t keep coming back before the court and expecting breaches to be tolerated. Should you breach again, you know what’s likely to happen on the next occasion."

This case was reported by the North Wales Chronicle, with coverage from reporter Matthew Chandler. It underscores the ongoing supervision required for offenders on suspended sentences, particularly in cases involving sexual offences against minors. North Wales Police were involved in the initial investigation, though specific details of the assault timeline remain undisclosed in public reports.
