Full Description

A man from Glasgow has been sentenced to prison after pleading guilty to a sexual assault on a vulnerable woman in her Dalrymple home. Shahzaib Hassan, aged 26, carried out the attack on December 21, 2023, when the victim was alone and allowed him entry into her residence.

The incident involved Hassan pushing his hands between the woman's body and arms to touch her breasts, an act he later admitted was intentional and not accidental. An additional allegation that he massaged her shoulders and arms against her wishes was removed as part of a plea deal with prosecutors. Court reports highlighted Hassan's initial denial of responsibility to social workers, despite his guilty plea, which raised concerns during sentencing proceedings at Ayr Sheriff Court.

Sentencing was deferred on multiple occasions for criminal justice social work reports and a risk assessment. Sheriff Shirley Foran expressed alarm over the contradictions in Hassan's background reports, noting comments that conflicted with his admission of guilt. The court learned that Hassan was due to marry in his home country and had been abroad during one deferral period. Upon his return on March 25, 2024, his solicitor explained that Hassan had been embarrassed and spoken foolishly to social workers, reaffirming his acceptance of the offence and expressing apologies to the court and victim. He indicated willingness to accept a non-custodial disposal.

However, Sheriff Foran deemed the behaviour predatory, stating: 'This woman allowed you entry and you attacked her in her home when alone and vulnerable. I see little remorse.' She emphasised the need for a custodial sentence to mark the seriousness of the offence. Hassan, of High Croft Avenue, Glasgow, was jailed for 36 weeks, reduced from 40 weeks due to his early guilty plea. Additionally, he was subjected to sex offender notification requirements for 10 years.
