Offence Summary

Naweed Nasery, a registered sex offender, breached his Sexual Harm Prevention Order by persistently approaching and messaging a 19-year-old woman in a hotel health club Jacuzzi, ignoring her requests to stop.

Full Description

Naweed Nasery, a 21-year-old sex offender from Exeter, has admitted to breaching his Sexual Harm Prevention Order (SHPO) by pestering a lone 19-year-old woman at the health club of the Mercure Exeter hotel where he worked as a porter. The incidents occurred in May 2022, highlighting Nasery's ongoing pattern of targeting isolated females despite legal restrictions designed to prevent such behaviour.

The court heard that Nasery, who resides on Cowick Street in Exeter, utilised his employment privileges to access the hotel's facilities. On the initial occasion, he approached the woman while she was relaxing alone in the Jacuzzi, sat beside her uninvited, and initiated conversation by inquiring if she was single, her age, and requesting her phone number. He expressed loneliness, stating he had no friends and wished to leave the premises with her. Approximately an hour later, Nasery sent her a WhatsApp message proposing they meet up, followed by additional texts over the subsequent days despite her explicit instructions to cease contact.

  • The woman received multiple unwanted messages and, on 17 May 2022, endured 11 missed calls from Nasery in a single day.
  • Upon her return to the health club, Nasery continued to harass her about becoming 'friends', prompting her to exit the hotel via an alternative route to evade him.
  • She repeatedly communicated her discomfort and demanded he leave her alone, but the persistence led her to contact Devon & Cornwall Police on 21 May 2022 after further messages.

Nasery's actions represent a flagrant violation of his SHPO, which explicitly prohibits him from approaching lone females. This order stems from his prior convictions for similar offences; notably, he was jailed in February 2022 for lingering in Exeter City Centre and engaging with women on their own. Authorities have assessed Nasery as a high-risk offender, with his behaviour under strict management. The Devon Live article, reported by Senior News Reporter Paul Greaves on 8 September 2022, details how Nasery's employment at the hotel provided the opportunity for these breaches, underscoring the challenges in supervising such individuals in public-facing roles.

In mitigation, defending counsel Ms Lisa McArthur noted that Nasery had been released from prison recall in August 2022 and had previously maintained stable employment at an Amazon warehouse without incident. She highlighted his serious mental health issues, for which he receives regular medical attention and offender management support. However, Nasery is no longer employed at the Mercure Exeter. Following his admission of guilt at magistrates' court, he was remanded in custody pending sentencing at Exeter Crown Court on 4 October 2022.
