Offence Summary

Daniel Rafferty exposed himself and performed a solo sex act next to a vulnerable schoolboy on a bus, encouraging the boy to watch, which caused the child significant distress.

Full Description

On a bus in Sheffield, 34-year-old Daniel Rafferty from Barnsley committed a shameless sexual offence by sitting next to a vulnerable teenage schoolboy and exposing his genitals. For approximately eight minutes, Rafferty engaged in a lewd solo sex act while staring at the boy and directing his attention to the act, leaving the child in evident distress. The incident occurred at the back of the bus, where around 10 other schoolchildren in uniform were present but did not witness the event due to their positioning.

The boy, dressed in his school uniform and travelling home, immediately texted his mother to describe the horrifying situation, noting that Rafferty seemed to want to be watched. Upon arriving at the bus terminus, both alighted, and Rafferty was later identified and arrested through CCTV footage and his travel pass. In his initial police interviews, Rafferty provided no comment, but he later pleaded guilty to charges of engaging in a sexual act in the presence of a child and exposure at an earlier hearing.

At Sheffield Crown Court, Judge Peter Hampton sentenced Rafferty, emphasising the boy's upset and bravery in reporting the incident promptly. The judge noted the complainant's vulnerability, greater than that of an average schoolchild, and highlighted the distress evident in the boy's video-recorded police interview. Prosecutor Stephen Littlewood detailed how Rafferty said 'oi' to draw the boy's attention to his actions. Rafferty's barrister, Richard Davies, submitted that his client had pleaded guilty early, expressed remorse through shame, lost his job, and had no prior similar offences—his criminal record stemming from juvenile non-sexual matters.

Judge Hampton imposed an 18-month custodial sentence, suspended for 18 months, along with a 35-day rehabilitation activity requirement and 200 hours of unpaid work. The judge explained that immediate imprisonment would limit rehabilitation opportunities, and public protection would be better served by addressing Rafferty's issues through probation support. Additionally, a 10-year sexual harm prevention order was made, and Rafferty was placed on the sex offenders' register for the same period. The judge warned Rafferty against breaching the order, stating that failure to address his issues would result in immediate custody.

This case, reported by The Star on 22 January 2026, underscores the importance of swift reporting and judicial measures to protect vulnerable children from sexual exploitation in public spaces.
