Offence Summary

Kyle Pauley held a knife to a young woman's neck, raped her, and stabbed her in the stomach in a Benfleet park. He was sentenced to 12 years in prison plus seven years on extended licence.

Full Description

On September 22, 2023, Kyle Pauley, a 24-year-old South African drug dealer, attacked a young woman in the Villa Road Recreation Ground in Benfleet, Essex. The victim was walking home, listening to music on her headphones, when Pauley approached her, held a knife to her neck, and forced her to comply with his demands out of fear for her life.

Pauley raped the woman and then stabbed her in the stomach before fleeing the scene. The victim managed to return home in a distressed state and was subsequently hospitalised due to her injuries. In a victim impact statement read out in court by prosecutor Claire Matthews, the woman described the ongoing trauma, including flashbacks, nightmares, panic attacks, and physical pain from the stab wound scar. She explained how the attack had profoundly affected her daily life, making her afraid to go out alone, listen to music with headphones, or even feel safe in her own home, where she now keeps the blinds shut constantly.

The victim's father provided an emotional statement during the sentencing hearing at Basildon Crown Court on January 8, 2024. Addressing Pauley directly via a video link from Chelmsford Prison, he expressed his gratitude that Pauley had pleaded guilty, sparing his daughter the ordeal of a trial. He urged Pauley to use his time in prison to reflect on his actions and emerge as a better person, while sharing his own emotional exhaustion from feeling unable to protect his daughter. The father also voiced concerns about his daughter's coping mechanisms, noting her use of alcohol to numb the pain rather than seeking therapy.

Judge Samantha Cohen, after viewing a recorded interview with the victim where she recounted her terror during the assault, sentenced Pauley to an extended sentence for public protection. This comprised 12 years' imprisonment followed by seven years on extended licence. The judge emphasised the severe harm caused to the victim, stating that Pauley had given no thought to the impact of his actions and that any remorse appeared self-serving. Evidence of potential deportation proceedings against Pauley was also noted in court.

The case was heard at Basildon Crown Court in Essex, with investigations conducted by Essex Police as part of their rape investigations unit. This incident highlights the brutal nature of the attack and its lasting effects on the survivor and her family.
