Full Description

Two brothers from Ipswich, Shubhashish Day and Debashish Day, faced trial at Ipswich Crown Court for historical sexual offences committed against a schoolgirl more than four decades ago. The case, which spanned a three-week trial, centred on allegations of indecent assaults occurring between 1982 and 1990 during games of hide and seek and other interactions with younger children.

Shubhashish Day, 56, of Limetree Drive, Ipswich, and his brother Debashish Day, 55, of Heath Road, Ipswich, jointly denied six offences of indecent assault from 1982 to 1984. The jury found them not guilty on all six counts. However, for a further nine offences between 1984 and 1990, they were acquitted of five but convicted on the remaining four by 10-2 majority verdicts. Shubhashish Day was also cleared of an additional charge of indecent assault and an offence of indecency with a child.

A third brother, Ramashish Day, 51, of Heath Road, Ipswich, denied eight joint offences and was cleared of all. During the trial, Shubhashish Day gave evidence denying suggestions that the brothers directed younger children during hide and seek games. He specifically rejected claims of entering a cupboard to kiss and grope a girl's breasts, and the accusation that they operated as a 'team' with one standing guard while others abused the victim. 'The idea they would behave in such a way was inconceivable,' he stated.

Judge David Wilson adjourned sentencing for Shubhashish and Debashish Day until 23 January. The convictions relate to sexual assaults on a schoolgirl, highlighting a pattern of abuse during childhood games. The case was reported by the Ipswich Star, with court proceedings held at Ipswich Crown Court in Suffolk.
