Full Description

Russell Maidment, a 32-year-old resident of Lower Innox near Frome, appeared in Bath Magistrates' Court after admitting to serious sexual offences involving children. The case stemmed from his actions in 2021 and 2022, where he engaged in six counts of sexual communication with a child and made a category C indecent photo or pseudo-photo of a child in February 2022.

On 10th November 2024, Maidment was sentenced by magistrates to a 12-month suspended prison sentence. However, an error occurred in the imposition of the reporting requirements under Section 82 of the Sexual Offences Act 2003. This section mandates that individuals receiving sentences exceeding six months, including suspended ones, must comply with sex offender notification requirements for 10 years to allow police monitoring and management of convicted sex offenders. Despite this, the court initially set the reporting period at five years, which was incorrect.

The error came to light shortly after sentencing, prompting magistrates to formally reopen the case on Monday, 15th December 2024. During the hearing, the court's legal adviser explained to Maidment that the mistake had not been identified at the time of his original sentencing. Maidment, who acknowledged his understanding of the reason for the correction, had the reporting requirements amended to the mandatory 10 years. No further changes were made to the suspended sentence itself.
