Rapualla Ahmadze, an asylum seeker from Afghanistan, was sentenced to nine years in jail for the rape of a vulnerable teenager in a 'shocking and violent' attack in Cooper Park, Elgin, Moray, on 4 August 2024. The incident occurred when Ahmadze approached the unknown victim, making intimidating remarks, before pulling her from a bench, kissing her, and restraining her. He then walked her to a children's play area in the park, where he touched her sexually, and subsequently took her to an area of bushes, pulled down her lower clothing, seized hold of her legs, and raped her. The assault culminated in an oral rape, leaving the victim subjected to profound and long-lasting harm.

Ahmadze, who is also known as Rafiullah Ahmadzai, appeared at the High Court in Edinburgh on Tuesday for sentencing following his earlier conviction by a jury on charges of rape and threatening or abusive behaviour. The court heard there was a dispute regarding his age, but he was believed to be around 20 years old at the time of the offence. Judge Thomas Welsh KC addressed Ahmadze directly, stating: 'You were convicted by the jury on the basis that you acted in a predatory manner and took advantage of a vulnerable teenager who was unknown to you, and you raped her in shocking and violent rape on rough ground in Cooper Park. The harm which you have done is profound and long lasting.' The judge described the ordeal as 'horrific' for the victim and noted that the jury had disbelieved Ahmadze's claim that the sex was consensual. He further emphasised that Ahmadze's actions were 'motivated by a brutal desire to take sex irrespective of the consent of the victim'.

In mitigation, defending lawyer Shaun Alexander acknowledged the seriousness of the crime but submitted that Ahmadze continued to maintain the encounter was consensual. Alexander requested the judge consider Ahmadze's age, maturity, and background, highlighting that he was born in Afghanistan, a 'country ravaged by war', where he did not have a typical childhood. The court was told Ahmadze had been conscripted by his uncle to assist with the Afghan National Army, but both were captured by the Taliban; his uncle was killed, and Ahmadze escaped after being shot in the arm. He fled Afghanistan in 2022, enduring an arduous journey to the UK in 2023, where he sought asylum. Alexander described Ahmadze as having endured 'significant adverse experiences' in his life.

Judge Welsh imposed a custodial sentence of nine years, backdated to August 2024, and placed Ahmadze on the sex offenders register indefinitely. The judge noted that the law expects deportation at the end of the sentence, though this would be a matter for the Home Office. Following the sentencing, Detective Inspector Sam Buchan of Police Scotland commented: 'Rapualla Ahmadze is a predatory individual who took advantage of a vulnerable young woman for his own gratification. He will now face the consequences of his actions.' Police Scotland reaffirmed their commitment to pursuing perpetrators of violence against women and girls, stating the conviction sends a 'strong message that sexual violence has no place in our communities'.
