Full Description

A 54-year-old man from Wareham, Dorset, has been handed a community order after admitting to voyeurism and possessing indecent images of children. Nigel Anthony Hamilton Smith appeared at Dorchester Crown Court, where he pleaded guilty to two charges of voyeurism and three offences related to indecent images.

The incidents came to light on 1 July 2023, when a 14-year-old girl was showering at a location in Wareham and noticed a suspicious hole in an aftershave box. Upon investigation, she discovered Smith's mobile phone concealed inside, actively filming her. Shocked, the girl deleted the footage but also uncovered another video from the previous day, showing her lying fully clothed on a sofa without her knowledge. Smith, who was employed as a prison officer at the time and had no prior convictions, was arrested shortly thereafter by Dorset Police.

During the police search of Smith's mobile phone, officers found three indecent images of naked children, classified as the lowest severity level (category A, level one). Nicholas Tucker, prosecuting, outlined these details to the court, emphasising the breach of trust given Smith's position and the age disparity between the offender and the victim.

Judge Roger Jarvis, presiding over the case, described Smith's actions as 'frankly a disgustingly shabby thing to do' and noted that such violations have lasting impacts on victims, particularly young children. He highlighted that the girl was 40 years younger than Smith and expressed belief that the defendant was ashamed, adding, 'so you should be.'

In sentencing, Judge Jarvis imposed a three-year community order, including a supervision requirement and mandatory participation in a sex offenders’ group work programme. Additionally, Smith was made subject to a Sexual Offences Prevention Order indefinitely and required to register on the Sex Offenders’ Register for five years.
