Dean Aaron Gee, a 29-year-old man from Scarborough, North Yorkshire, faced legal consequences after admitting to possessing indecent images of children. The case came to light following a theft incident in Manchester, where a thief broke into his car and stole his laptop computer, leading to the discovery of child sex images on the device.

Gee was charged with 17 counts of possessing an indecent photograph of a child. On 11 May 2011, he was sentenced to 10 months in prison at Manchester Crown Court after pleading guilty. However, his legal team appealed the decision, arguing that the sentence was inappropriate given his background and low risk to society.

The Court of Appeal, comprising Lord Justice Rix, Mr Justice Stadlen, and Mr Justice Hickinbottom, heard the case in London. They quashed the custodial sentence, citing 'exceptional mitigation'. A psychiatric report highlighted Gee's vulnerability in prison, stating he 'would probably be abused and made another inmate's bitch', and noted a real risk of him becoming suicidal if sexually abused while incarcerated. The judges described the material on his computer as 'utterly abhorrent' but emphasised that Gee had lived an 'exemplary life' despite an 'appallingly dysfunctional' childhood marked by persecution and trauma.

Evidence presented showed that Gee's possession of the images stemmed from his own childhood trauma, and reports indicated he did not pose a risk to real children in the future. He had devoted his life to positive endeavours, including setting up a charity to help young people. Mr Justice Stadlen concluded that this was 'one of those very rare and exceptional cases in which the public interest didn't lie in a sentence of imprisonment'. Instead, Gee was placed on a three-year community order, requiring him to attend a sex offenders treatment programme.

The original sentencing occurred at Manchester Crown Court, with the appeal decision delivered by the Court of Appeal. This outcome reflects the judiciary's consideration of individual circumstances in sentencing for possession of child abuse images.
