Aaron Carson Swan, a 39-year-old man from Jedburgh in the Scottish Borders, has been sentenced to an indeterminate period of imprisonment with a minimum term of six years following his conviction on multiple serious charges, including the rape of three women. The offences, spanning from 2013 to 2022, involved sexual assaults, domestic abuse, and coercive control, culminating in a lifelong restriction order designed to protect the public from his assessed high risk of reoffending.
The High Court in Inverness heard that Swan committed his first rapes in April 2013, targeting two women who were asleep and thus unable to consent at a property in the Scottish Borders. These acts formed part of six charges for which he was found guilty, highlighting a pattern of predatory and manipulative behaviour. In February 2020, Swan raped a third woman after she withdrew consent during sexual intercourse, demonstrating a disregard for boundaries and consent. Additionally, Swan was convicted under Section 1 of the Domestic Abuse (Scotland) Act 2018 for engaging in coercive and controlling behaviour towards a partner. This included repeated telephone contact, harassment, psychological manipulation, monitoring her movements, seeking information from her relatives, and issuing threats of violence while also threatening self-harm. In July 2019, he assaulted this victim by strangling her and pinning her against a car after summoning her under false pretences of needing help.
During the sentencing on 3rd May 2024, Judge Lord Weir described Swan's actions as exhibiting a 'capacity for violent, manipulative, self-centred and, frankly, sinister behaviour' that had a 'profound and lasting effect' on his victims. Lord Weir emphasised the severity of the crimes, stating: 'The nature and circumstances of the crimes you were found to have committed, coupled with your record, the many risk factors identified in the risk assessment report, and the lack of any significant protective factors, are such as to satisfy me that there is a likelihood that, if at liberty, you will seriously endanger the lives, or the physical or psychological well-being, of members of the public at large.' The judge imposed an Order for Lifelong Restriction (OLR), an indeterminate sentence where Swan will only be considered for release if the Parole Board deems public safety assured. There is no guarantee of release after the six-year minimum punishment part.
In addition to imprisonment, Swan has been indefinitely placed on the Sex Offenders Register and banned from contacting his victims. Scotland’s Procurator Fiscal for High Court Sexual Offences, Katrina Parkes, commended the victims' courage, noting: 'The victims of Aaron Carson Swan’s depravity have shown great courage and resolve in coming forward and reporting him to the authorities. Their evidence has ensured he has been held to account for his appalling criminal behaviour and their bravery has helped protect other women from this dangerous individual.' Detective Constable Jessica Laycock from Police Scotland added that the sentencing provides closure for the victims and reaffirmed the force's commitment to investigating sexual abuse reports robustly, regardless of timescale.
